From condominiums in JB city centre to serviced apartments in Iskandar Puteri, thousands of property owners now hold strata titles governed by the Strata Titles Act 1985 and the Strata Management Act 2013. While strata living offers many advantages, it also creates a unique set of legal obligations and potential disputes that property owners should understand.
What Is a Strata Title
A strata title is a certificate of title issued for a parcel within a subdivided building. Unlike a traditional individual land title, a strata title defines the owner's parcel by reference to a floor plan lodged with the Land Office. The owner holds the parcel as a separate and distinct property, while the common property, which includes corridors, lifts, swimming pools, gardens and parking areas, is jointly owned by all parcel holders through the management corporation. The Strata Titles Act 1985 regulates the process of strata subdivision and the issuance of strata titles, while the Strata Management Act 2013 governs the day-to-day management of strata schemes.
Common Issues and Disputes
One of the most common issues facing strata property owners in JB is the delay in the issuance of strata titles by developers. Under the law, developers are required to apply for strata titles within a prescribed timeframe, but in practice, delays of several years are not uncommon. This creates problems for owners who wish to sell or refinance their properties. Another frequent source of dispute is the management of the common property. Disagreements between the management corporation and parcel owners over maintenance fee increases, the quality of building maintenance, the appointment of managing agents, and alterations to common property are all common. The Strata Management Tribunal, established under the Strata Management Act, provides a relatively accessible forum for resolving many of these disputes without the need for formal court proceedings.
Your Rights as a Parcel Owner
As a strata parcel owner, you have the right to enjoy your property without unreasonable interference from the management corporation or other parcel owners. You have the right to attend and vote at general meetings of the management corporation, to inspect the accounts and records of the corporation, and to challenge decisions that are made improperly or in breach of the Act. You are also entitled to receive a copy of the house rules and to be consulted on any proposed amendments. On the flip side, you are obligated to pay maintenance charges and contributions to the sinking fund on time, to comply with the house rules, and not to carry out any renovation or alteration to your parcel that affects the structural integrity or external appearance of the building without the prior written consent of the management corporation.
